Further, it discussed Malaysia’s pre-emptive measures to stop the spread of the disease into Malaysia, and the subsequent objections from trading partners which may translate into another potential cost to Malaysia. The study focuses on case studies, literature reviews and existing data with regards to ASFV, as well as Malaysia’s experience of a similar incident of pig-related diseases, the Nipah virus in 1999. However, the information on the actual cost or estimated cost of the process to eradicate the disease, or the legal costs of engaging the dispute settlement mechanism on this issue are unavailable, and thus formed the limitations of this study. Malaysia, as a member of the World Trade Organization (WTO), has the commitment to adhere to the Agreement on the Application of Sanitary and Phytosanitary (SPS Agreement). Implementing the SPS Agreement, however, must consider the internal and external factors of the country, to simultaneously balance the SPS implementation principles in protecting human, animal or plant life or health and at the same time liberalising international trade. The SPS Agreement provides flexibility for members to implement measures necessary to protect human, animal or plant life or health. However, the measures must not be arbitrary and are in compliance with the SPS Agreement principles. It is also necessary to examine the impact of the SPS measures to other members, and the potential repercussions. Government officers must be well versed with the commitments under the SPS Agreement and implementation of SPS measures to ensure compliance with agreement and avoid unwanted legal proceedings under the WTO dispute settlement system, or retaliations by other members through similar measures which would be costly to Malaysia.
