577 Varia Ranah: Sorotan Ilmiah Perkhidmatan Awam WHAT IS A PUBLIC SERVICE ACT AND WHY DOES MALAYSIA NEED A PUBLIC SERVICE ACT A Public Service Act generally would include and outlines the basic terms and conditions of employment in addition to identifying the rights and responsibilities of employees and employer; (in this case of government officers and the government). It is to ensure Public Servant should be given due respect in order for them to carry out their responsibilities professionally and independently without political interference and oppression; to state the powers, separation of powers, functions, and demarcation of powers between Members of the Administration and Public Servant; and to enhance the governance and the integrity of the Public Service. An idea for a Public Service Act in Malaysia should include apolitical approach, Demarcation of powers between administrative and public servants, Power, Duties, Legal Rights, Liability, Creation of Power, Functions & Responsibilities, Code of Conduct and Public Service Principles. WHAT IF MALAYSIA HAS OR DOESN’T HAVE A PUBLIC SERVICE ACT Malaysia should have a public service act as Malaysia is a developing Nation. This would be a precursor to be seen as a nation on its way to a developed nation status by having a Public Service Act. Furthermore, separation of powers is crucial to ensure smooth implementation of public services that would not be hindered by political power and Civil servants especially shall implement all duties and responsibilities without political influence. To ensure Public Servant be given due respect in order for them to carry out their responsibilities professionally and independently without political interference and oppression; to state the powers, separation of powers, functions, and demarcation of powers between Members of the Administration and Public Servant; and to enhance the governance and the integrity of the Public Service
