573 Varia Ranah: Sorotan Ilmiah Perkhidmatan Awam Thirdly, to ensure that disciplinary action is not taken lightly, and is grounded in the fundamental principles of the discipline of public service administration. Fourthly, the government reserves the right to set up the organization, creation/ termination of employment and conditions of employment. The last two are that the Public Service Commission is established to be responsible for public service matters relating to the appointment, promotion, and disciplinary control and the Federal Government is responsible for Federal and State pensions. Therefore, the state public service is still under the control of the federal government [Art. 112 FC]. The establishment of Public services are to mainly enforce laws, including those relating to the collection of State revenues; to formulate and implement policies through various Ministries and Departments, including financial management relating to the national economic development; and involving in the management of physical and operational work. In short, various “Head of Departments” positions have been created in the Constitution, either through Article 144 (3) of the FC or through the specific Act. There is no specific Act on the terms of service, except for the police and the army, for the administration of public services. Similarly, no Service contract document (Officer is subject to any General Order, regulations, and circulars of service) nor relations between Government and Public Officers are bound by any contract of service. Appointment of Officers, followed by appointment or assignment, and deemed 'civil servant' for the purposes of the Penal Code. The source of legislative powers in terms of service is based on Article 132 of the Federal Constitution. This includes the appointments and appointments are essentially carried out by the various Service Commission (Article 144 FC). The legal basis for disciplinary action is governed by Article 135 FC and the matter of fair treatment under Article 136 FC.
